Richmond star Dustin Martin's father, Shane, has won his court battle against deportation to New Zealand.

Shane Martin has been living in New Zealand since being deported from Australia last March under section 501 of the Immigration Act due to his links to the Rebels motorcycle club.

After the Government dropped its case in court on Tuesday, it means Martin is expected to be allowed to return to Australia.

The decision comes after Immigration Minister Peter Dutton conceded a legal error was made in the decision to deport him.

However, there is still one hurdle martin must pass in order to re-enter the country. He will now have to apply for a visa to re-enter Australia, but there will be strict entry requirements he must meet to gain access.
